Terms & Policies

1) Service Overview

Money Maker Marketing provides promotional visibility services for gamers, streamers, clans, and tournament organizers, which may include: (a) an animated HTML5 listing card, (b) a shareable placement link to an assigned slot within a state network, (c) an optional shareable “hub page” (Pro), (d) optional Premium placement add-ons, and (e) optional event/tournament promotional pages.

The Services are designed as a promotion network you can share across social platforms and communities. The Services do not guarantee followers, subscribers, sponsorships, matchups, revenue, or business outcomes.

2) Eligibility & Accounts

• You must be able to form a binding contract to use the Services.
• You are responsible for ensuring your use complies with applicable laws, platform rules (Twitch/YouTube/etc.), and community guidelines.
• If you provide account, billing, or contact details, you agree they are accurate and you will keep them updated.

3) Listings, Placements & Inventory

A. Standard Placement (Network Pages)

• Assignment: Standard placements may be assigned automatically based on availability, or selected where offered.
• Active service: Your placement remains visible while your subscription is active and in good standing.
• Release: If billing lapses beyond any stated grace period, the placement may be paused and/or released.

B. Premium Placement (Optional Add-On)

• Plan required: Premium is an add-on that requires an active Essential or Pro plan.
• Limited inventory: Premium placements are limited and may sell out.
• Non-guarantee: Premium improves visibility/position; it does not guarantee traffic, growth, or results.

C. Slot Links & Sharing

• We may provide a direct link to your slot location and/or a shareable profile/hub link.
• You are responsible for where you share and how you promote your link(s).

4) Subscriptions, Billing & Payments

• Recurring billing: Monthly services renew automatically unless cancelled.
• Setup fees: One-time setup/activation fees apply to Essential and Pro plans.
• Payment failures: If payment fails, we may retry billing and/or pause services after a grace period.
• Taxes: Prices may be subject to applicable taxes based on your location and applicable law.
• Price changes: We may update pricing with reasonable notice; changes apply at your next renewal unless stated otherwise.

5) Setup, Production & Go-Live

• Work order: Production begins after we receive required details/assets (gamer tag, platform, links, images/logos, etc.).
• Timeline: Typical go-live is 24–72 hours after a completed work order, subject to workload, revisions, and asset completeness.
• Revisions: Plan tiers may include a defined number of minor revisions; additional revisions may be billed.
• Updates: You are responsible for promptly notifying us of changes to handles, links, or brand assets.

6) Refunds, Cancellations & Chargebacks

A. Setup / Activation Fees

• Setup fees may be refundable only if cancellation is requested before production begins.
• Once production begins (e.g., design/programming work starts), setup fees become non-refundable due to custom production and placement processing.

B. Subscription Fees

• Subscription fees are generally non-refundable for time already served.
• Cancellation stops future renewals; service typically remains active through the current billing period.

C. Chargebacks & Disputes

• If you dispute a charge without contacting us first, we may pause services while the dispute is investigated.
• Unresolved chargebacks may result in account suspension and/or collections as permitted by law.

7) Clan Battles & Tournament Promotions

Promotional services for battles/tournaments may include a featured promo card, a dedicated promo page, and/or timed placement for a defined period. Unless otherwise stated in writing, event promotions are time-boxed and expire at the end of the purchased promo period.

• Client responsibilities: You must provide accurate event details, stream links, bracket links, dates, and any sponsor assets you have rights to use.
• No guarantee: We do not guarantee attendance, viewers, sign-ups, or outcomes.
• Changes: Late changes (e.g., day-of time changes) may not be accommodated; rush updates may incur fees.

8) Content Rules & Client Responsibilities

You are responsible for all content you submit or request us to publish, including claims, offers, and compliance with: (a) laws and regulations, (b) platform rules (Twitch/YouTube/Discord/etc.), and (c) community guidelines.

Prohibited Content

• False, misleading, or deceptive claims (including “guaranteed wins,” “guaranteed money,” or “guaranteed results”).
• Harassing, hateful, discriminatory, violent, or unlawful content.
• Infringing content (logos, images, music, video) you do not have rights to use.
• Requests that imply Money Maker Marketing will facilitate wagers, hold escrow, or process payments between players.

We may request edits, pause, or remove content we believe is misleading, non-compliant, or harmful, without liability.

9) Intellectual Property

• Our materials: The website, layouts, templates, code, and branding are owned by Money Maker Marketing and/or its licensors.
• Your materials: You retain ownership of your trademarks and content you provide. You grant us a non-exclusive license to use them to provide the Services.
• Restrictions: Resale, redistribution, or template cloning is not allowed without written permission.

10) Third-Party Services & Links

The Services may link to or embed third-party services (e.g., Twitch, YouTube, Discord, X, Instagram, payment processors, analytics). We do not control third-party services and are not responsible for their availability, content, or policies.

Your use of third-party services is governed by the third party’s terms and privacy policies.

11) Disclaimers

• No guarantee: We do not guarantee rankings, traffic, followers, subscribers, sponsorships, revenue, or outcomes.
• Promotion only: We provide advertising and promotion services only and do not facilitate wagers or payments between players.
• “As is”: Services are provided “as is” and “as available.”
• Downtime: We may perform maintenance or experience outages; we are not liable for temporary unavailability.

12) Limitation of Liability

To the maximum extent permitted by law, Money Maker Marketing and its owners, employees, and partners will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or business interruption.

To the extent liability is not legally excludable, our total liability for any claim related to the Services will not exceed the amount you paid to us for the Services in the three (3) months preceding the event giving rise to the claim.

13) Indemnification

You agree to indemnify and hold harmless Money Maker Marketing from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your content, your misuse of the Services, your violation of law or platform rules, or your infringement of third-party rights.

14) Dispute Resolution

Before filing a formal claim, you agree to contact us at info@moneymakermarketing.com and attempt to resolve the issue informally.

If a dispute cannot be resolved informally, the parties may pursue resolution in a court of competent jurisdiction, unless a separate signed agreement specifies arbitration or another method.

15) Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law rules, unless otherwise required by applicable law.

16) Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on this page with an updated “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance.
